DediByte LLC Terms of Service
1. Acceptance of Terms
Welcome to DediByte LLC ("DediByte," "we," "us," or "our"). By accessing or using any of our services, including but not limited to Virtual Private Server (VPS) Hosting, Dedicated/Bare Metal Servers, and Colocation (collectively referred to as the "Services"), you acknowledge and agree to be bound by these Terms of Service ("Terms").
Please read these Terms carefully. If you do not agree to them, you must discontinue use of our Services immediately.
2. Service Locations
DediByte LLC currently offers services in the following data center locations:

3. Payment Terms
Accepted payment methods include:

Cryptocurrency via approved processors (e.g., Cryptomus)

PayPal
-
Credit/Debit Cards via Square or Stripe
By using our Services, you authorize DediByte LLC to charge your selected payment method for all applicable fees. We may process payments up to 7 days in advance of the due date to prevent interruptions.
All cryptocurrency transactions are strictly non-refundable. NO EXCEPTIONS.
4. Automatic Renewal
All services are automatically renewed unless explicitly canceled beforehand. You are responsible for canceling your service prior to the renewal date to avoid being charged for the next billing period.
5. Refund Policy
Refunds are not guaranteed. Refunds may be considered under the following circumstances:

If a service is not deployed within 72 hours of payment (unless a longer deployment time is explicitly stated).

If a verified technical issue caused solely by DediByte LLC prevents proper use of the service and is deemed unresolvable.
If a refund is granted, it will typically be issued as store credit with no expiration.
NO REFUNDS for Cryptocurrency transactions—ALL SALES FINAL.
6. Cancellations
To cancel a service, you must submit a cancellation request via the client area by selecting the service and choosing "Request Cancellation."

Immediate Cancellation: Deletes the service within 24 hours.

End of Billing Cycle: Cancels the service at the end of its paid term.
Requests must be submitted before the service due date to be processed in time. Failure to cancel in time may result in the service renewing and charges applying.
/24 Subnets require a 30-day cancellation notice. Failure to provide this notice may result in continued billing and/or suspension of other services.
7. Acceptable Use Policy (AUP)
By using our Services, you agree to follow our AUP, which includes but is not limited to:

No illegal activity (fraud, phishing, DDoS attacks, unauthorized access, etc.)

No hosting of malware or participating in botnet-related activity

No spamming or misuse of network resources

No violation of intellectual property rights
Violations may result in immediate suspension or termination without notice or refund.
8. Data Responsibility and Security
DediByte LLC does not guarantee the integrity or availability of customer data.
We are NOT responsible for any data on your server. Unless explicitly stated, no backups are kept by DediByte. Clients are fully responsible for implementing their own backup and data protection procedures.
9. Account Suspension and Overdue Services
Failure to cancel your services and allowing them to go overdue may result in account suspension. In the event of suspension, all associated services may also be suspended or terminated. DediByte reserves the right to enforce this policy without prior notice.
10. Service Liability Disclaimer
DediByte LLC is not liable for:

Data loss or corruption under any circumstance

Service interruptions due to third-party software, network providers, or customer misconfiguration

Indirect or consequential damages, including lost revenue or opportunities
11. Changes to These Terms
We reserve the right to modify or update these Terms of Service at any time. Notification of changes may be provided through:

A notice posted on our website

Email notifications sent to your registered contact
Continued use of our services after changes implies acceptance of the updated Terms.
12. Governing Law
These Terms are governed and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law principles.
